These instructions are for Wake County only. For other counties, click here for instructions. Be sure to carefully read the instructions below. Be sure to use black ink when filling out this form.
1. Fill in your case file number.
2. Fill in your full name.
3. Fill in your spouse's full name.
4. Fill in your attorney's name (if applicable). If you are doing the absolute divorce on your own, you will leave this blank.
5. Fill in your spouse's attorney's name (if applicable).
6. Check the appropriate one (most people will choose "Non-Jury Divorce").
7. List the date requested for your divorce hearing. Be sure to count 30 days from the day after the summons was served. The first Friday after the 30 days has expired is the day you may set as your court date.
8. As long as your spouse has been sent a copy of this Notice of Divorce Hearing form, write yes.
Fill out three copies of this form. Take all three copies to the Clerk of Court's Office (8C in Wake County) and clock them in. One of the copies will go in the Clerk's basket, the second copy will be mailed by you to your spouse, and the third copy will be for you to keep and take with you to court for your absolute divorce.
